ORGANIZATIONAL AND OPERATING DOCUMENTS


  • THE DECLARATION:  The Declaration serves as the Association's "constitution."  It is the first of the legal documents prepared which creates and empowers the Association to exercise the corporate rights of the community. Its creation is authorized by the Ohio State Legislature in Ohio Revised Code Chapter 5311.  Upon its execution by the Association's incorporators, it was recorded in the office of the County Recorder of Cuyahoga County for posterity.

THE BYLAWS:  The ByLaws define in detail the relationships, duties, and responsibilities of the Board of Directors who govern the corporation, the officers who manage and operate the corporation and the residents who own and live at the corporation's resident facility.

 THE RULES, INFORMATION & PROCEDURES :  The Rules, Information & Procedures manual further clarifies and specifies the interpretation of the regulations found in the ByLaws about residents' use and maintenance of the Common Areas, including, but not limited to, the Party Room, the Library, the Mail Room, the Garage and the Courtyard.  In addition, it contains procedures for the Board and residents to follow governing complaint protocols, violation and enforcement procedures and assessments, association fees and sales of a unit.

THE RESERVE STUDY :  The Reserve Study is a report prepared by a professional or firm with property management expertise whose purpose is to inventory all tangible assets of the Association, estimating their remaining useful lives and a replacement cost of each.  Under Ohio law the Association is required to fund and maintain a Reserve Fund in an amount sufficient to replace the capital assets at the end of their useful lives.  The estimates provided to the Association in the Reserve Study assist the Board with planning and paying for replacement of these assets as needed over time.

THE PARTY ROOM -  For residents' guests or just for the residents themselves, a large party room, equipped with a full kitchen and bar, is available for use by any resident free of charge unless food is being served when there is a small fee for cleaning after usage.

THE COURTYARD - 


The Courtyard provides residents of The Victorian with that quiet oasis so often longed for in the midst of life's daily pressures.  With a set of outdoor benches for a "take a load off" moment, residents can sit quietly either listening to nature's serenade compliments of our local bird population or catching up on "going- ons" with another resident or a local friend.
